PRIVACY POLICY

Ochre Naturopathy strictly complies with the Australian Privacy Principles set out in the Privacy Act 1988 (Cwlth). The Australian Privacy Principles govern the way qualified health practitioners, including Naturopaths, collect, use, disclose, store, secure, alter and release personal information.

This privacy policy outlines my ongoing responsibility to you regarding the way I collect, handle and manage your personal information. Ochre Naturopathy reserves the right to make changes to this privacy policy at any time. 

​PERSONAL INFORMATION

​Personal information is any information about a person that allows that particular person to be identified, for example name, date of birth, address, telephone number, email address etc. It also includes any information about a person’s past, current or future health, their current or future use of health services, health services provided to the person and information collected whilst providing a health service to a person. 


COLLECTION AND USE OF PERSONAL INFORMATION

Both before and during a Naturopathic consultation, I may ask to collect some or all of the above personal information. I may collect this information in a number of ways including via patient intake forms, email and telephone, through this website and/or face-to-face discussion. I will only collect your personal information with your full awareness and informed consent. Any personal information I collect is strictly private and confidential. When collecting your personal information I will endeavour to explain the purposes for which the information is being collected, and how I plan to use it. 

​Your personal information will only be used for the primary purpose for which it was collected, or for directly related secondary purposes which could be reasonably expected by the individual. Where your personal information needs to be used outside of the primary, or related secondary purposes, then I will ask for your full informed consent for the use of your personal information for that particular purpose.

THIRD PARTIES

Where reasonable and practical to do so, I will collect your personal information from you directly. In some circumstances however, your personal information may be provided to me by third parties. When this is the case, I will take the reasonable steps to ensure that you are made aware of the personal information that has been provided to me by any third parties.

PROFESSIONAL CONSIDERATIONS

As a qualified health practitioner I am required by law, to identify my patients by collecting their name, date of birth and address. If you fail to provide me with this information, I cannot provide you with my services.

Before and during a consultation, you may choose not to disclose aspects of your personal information with me. Please keep in mind that this can impact treatment efficacy, and may pose a risk to your safety.   

ACCURACY AND QUALITY OF PERSONAL INFORMATION

I take every reasonable measure to ensure that the personal information I collect, use and/or disclose is thorough, accurate, complete and up to date at all times. Personal information is reviewed regularly to achieve this. If you find that your personal information is inaccurate or is not up to date, please advise me in writing, as soon as possible so that I can update my records accordingly.

SECURITY OF PERSONAL INFORMATION   

Additionally, I take every reasonable measure to ensure that your personal information is protected from misuse, interference and loss, as well as unauthorised access, modification and disclosure. Personal information is always stored securely in a safeguard file on a password-protected computer, that only I have access to. All archived personal information is securely destroyed after seven years.

DISCLOSURE OF PERSONAL INFORMATION   

Under certain circumstances, I may be required to disclose personal information about you. This typically occurs during professional oral or written (i.e. referral letters) discussions or information-sharing with other qualified health practitioners regarding your health and/or the best course of action for your treatment. Any discussions or information-sharing of this kind will not include any identifying information without your full informed consent.

I may also be required or authorised by the law, and government and law enforcement officials to disclose personal information about you:

  • In the course of a legitimate subpoena, legal request or court order, or in the investigation of a suspected crime

  • If I feel that disclosure to a responsible person is required to prevent physical or financial harm to anyone

  • If there is a serious threat to a person’s life, health or safety (i.e.in the event of an emergency)

  • In order to establish, exercise and defend my legal responsibilities and rights

If you have any concerns regarding the disclosure of your personal information, please make this known to me.

ACCESS AND CORRECTION OF PERSONAL MATERIAL

By law, you have the right to access any personal information held about yourself at your request, unless an exemption or other restriction as set out in the Privacy Act 1988 applies. You may also correct or update any personal information held about yourself at any time.  

If you wish to access or correct/update your personal information, a request must be made in writing to perri@ochrenaturopathy.com.au. Copies of personal information are only available for collection, in person. In order to protect your personal information, photo identification is required upon collection.

PRIVACY POLICY BREACHES AND COMPLAINTS 

If I have reason to suspect that a serious breach of data has occurred, which may result in harm or loss to you, I will immediately take appropriate remedial action. If I still believe that you are at risk I will notify the Office of the Information Commissioner, and then notify you directly.

If you feel a breach of this privacy policy has occurred, or you have a complaint regarding this privacy policy, please contact me via email at perri@ochrenaturopathy.com.au, so that I can attempt to resolve the issue. If you are not satisfied with my response, you may seek a review by contacting the Office of the Australian Information Centre available at https://www.oaic.gov.au/individuals/.
